There are many different ways in which drug crimes are prosecuted with even more severe penalties, including distributing controlled substances near a school.

Although Virginia has very strict drug distribution penalties, they can carry even more severe penalties under certain circumstances. One of those situations is if the person arrested for drug distribution was near certain areas. These areas include all schools, day care center, school buses, libraries, recreation centers, community center or college campus.

If the drugs were distributed on these grounds or within a thousand feet of the previously mentioned locations a defendant can face additional penalties. This also includes within a thousand feet of a bus stop in which children are present.

If a person has been arrested in one of these situations, they can be facing a felony with up to 5 years in prison and fines up to $100,000. This includes selling, distribution or manufacturing controlled substances.
